Equipment Fund Terms and Conditions

Where we have written to you and have confirmed that you will have access to an equipment fund that you can use to purchase certain products, and the applicable amounts (the Equipment Fund) the following terms will apply.

Please read these terms and conditions carefully. We recommend that you print and / or save a copy of these terms for future reference. By ordering products using the Equipment Fund, you confirm that you accept these terms and agree to comply with them.

The Equipment Fund is provided by Croft Communications Limited (we, our and us). We are registered in England and Wales under company number 12288133 and have our registered office at Ground Floor, Unit E1 The Chase, John Tate Road, Hertford, Hertfordshire, United Kingdom, SG13 7NN.

Your rights

You can use the Equipment Fund to place orders for products with us by contacting your key account manager or our dedicated customer services team on 01920 466466. Where we receive a valid order, the value of the order (defined as the “Charges” where we have a direct contract with you pursuant to our standard T&Cs (Contract)) will be offset against the Equipment Fund.

Where any valid order placed by you exceeds the balance in your Equipment Fund we will issue a separate invoice to you for the excess amount which shall be payable to us in accordance with our usual payment terms as confirmed to you in writing from time to time. Please note that we shall have sole discretion over which products can be purchased using the Equipment Fund.

You can get in touch at any time with your key account manager to check the remaining balance for your Equipment Fund.

Our rights and actions

You acknowledge that your access to the Equipment Fund is provided at our discretion as a financial incentive and because you are a valued customer, and the amount of the Equipment Fund shall be determined (and may be amended at any time) at our sole discretion. We reserve the right to withdraw or restrict your access to the Equipment Fund and to reduce the credit balance to nil at any time, including (but not limited to) in the circumstances described below. We may amend these terms from time to time, and wherever possible, we will use all reasonable endeavours to give you notice of any changes. However, we strongly recommend that you check these terms periodically.

Certain restrictions apply

You may only use the Equipment Fund to place orders for equipment and the Equipment Fund otherwise holds no monetary value, and we will be under no obligation to issue you with cash or a credit note equivalent in lieu. For the avoidance of doubt, you will not be entitled to use the Equipment Fund where you have failed to pay any charges which are otherwise due and payable to us, and you will not be able use the Equipment fund to offset against any such outstanding charges amounts.

Where you have a direct Contract with us your access to the Equipment Fund will end with immediate effect (and any remaining credit balance will be automatically reduced to nil) where either party gives notice to terminate the Contract for any reason or it otherwise comes to an end. In addition, where the Contract is suspended we reserve the right to suspend your access to the Equipment Fund.

Interaction with our standard T&Cs

Please note that where you have a direct Contract with us and we make an Equipment Fund available to you, then if there is any inconsistency between the provisions of our standard T&Cs and these Equipment Fund Terms and Conditions, these Equipment Fund Terms and Conditions shall prevail, to the extent of such conflict.
